These Terms of Use ("TOU") outline the rules and regulations for using our website, Xgirls.ai, and the services available through it (the "Services"). Please carefully review these TOU before accessing or using Xgirls.ai. 1. ABOUT Xgirls.ai

The website is owned and operated by **OpenFace Corporation**, a company registered in the United States, with its principal place of business located in Las Vegas, Nevada ("Xgirls.ai" or "We", "Us", "Our"). We collect different types of personal information based on how you use our Services:

Xgirls.ai provides users with the ability to engage in conversations with AI-generated characters. These characters are customizable by the users, and the platform may also offer interactions with characters developed by other users.

Xgirls.ai also allows users to generate images based on text descriptions. While we aim to ensure the images generated are appropriate and safe, we cannot guarantee their accuracy or suitability. We encourage users to use this feature responsibly, recognizing that the AI-generated images may not always be realistic or accurate.

To use our Services, users must create an account by registering either through social logins (e.g., Google) or with their email address and password.

The core Services of Xgirls.ai are offered free of charge, providing basic functionalities such as generating a limited number of characters and sending a set number of messages. However, users can purchase additional credits to access premium features as described on our Website.

For example, users on the free plan can create up to 2 or 3 characters and send between 10 to 20 messages before their limit is reached. Additional credits may be earned by completing specified tasks or by purchasing them. Paid subscriptions offer extended features, such as the ability to create more characters and access message credits ranging from 5,000 to 20,000 per month, depending on the subscription tier. Credits are reset monthly and do not carry over to the next subscription period.

2. Eligibility

You must be at least 18 years of age to use Xgirls.ai. If you are under 18, you may not access or use the Services in any capacity. By using the Services, you confirm that you meet this age requirement.

3. Account Registration and Security

To access the full range of Services, users must register for an account by providing accurate information, including an email address and password. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account

4. Paid Services and Subscriptions

While some Services are available for free, Xgirls.ai offers additional features and content that require payment. Subscriptions may include access to additional characters, messages, and premium features. All payments are processed securely through third-party providers, and you are responsible for any applicable taxes. By subscribing to paid services, you agree to the terms of the subscription, including any renewal or cancellation policies.

5. User Conduct

You have the right to:

Post, upload, or transmit any content that is illegal, defamatory, obscene, or harmful.
Harass, abuse, or harm other users or engage in any form of misconduct.
Use the Service for commercial purposes without our explicit consent.

Violating these rules may result in the suspension or termination of your account.

6. User-Generated Content

Xgirls.ai allows users to create and interact with characters and other content. You retain ownership of any content you create but grant Xgirls.ai a perpetual, royalty-free, non-exclusive license to use, distribute, and modify your content within the platform.

We do not claim ownership of the content users generate but reserve the right to remove or modify any content that violates these TOU.

7. Intellectual Property

All content on Xgirls.ai, including text, images, software, and designs, is the property of Xgirls.ai or its licensors. You may not copy, distribute, or create derivative works from our content without prior permission. Any unauthorized use of the content is strictly prohibited.

Payments for subscriptions and other paid features must be made through authorized payment providers. Xgirls.ai does not offer refunds for any payments made unless required by law or in exceptional circumstances. You may cancel your subscription at any time, but cancellation will take effect at the end of the current billing cycle. No refunds will be issued for unused portions of your subscription.

12. Disclaimers

The Services are provided "as is" without any warranties of any kind, either express or implied. Xgirls.ai does not guarantee that the Services will be error-free, uninterrupted, or free from harmful components such as viruses. We disclaim all warranties to the fullest extent permitted by law.

13. Limitation of Liability

Xgirls.ai is not liable for any damages arising from your use of the Services, including direct, indirect, incidental, or consequential damages. Our maximum liability for any claim is limited to the amount you have paid us in the last six months for using the Services.

15. Governing Law and Jurisdiction

16. Termination

Xgirls.ai reserves the right to terminate or suspend your account at any time, with or without cause, for any violation of these TOU or misuse of the Services. Upon termination, you must cease all use of the Services.

18. Advertisement Disclaimer

Xgirls.ai is not responsible for the content of advertisements or third-party links on the platform. Any interactions you have with advertisers are at your own risk.

For users accessing Xgirls.ai through the Google Play Store, the following terms apply:

You acknowledge that the TOU are between you and Xgirls.ai, not Google.
Google bears no responsibility for providing support or handling claims related to the Service.
Your use of Xgirls.ai must comply with the Google Play Terms of Service.

22. Additional Terms Relevant to Apple Inc.

For users accessing Xgirls.ai through the Apple App Store, the following terms apply:

You acknowledge that the TOU are between you and Xgirls.ai, not Apple.
Apple is not responsible for the performance, support, or content of Xgirls.ai.
Your use of Xgirls.ai must comply with the Apple App Store Terms of Service.
